Notice of the Shanghai Municipal Administration for Market Regulation on Further Strengthening the Supervision of Bulk Food Safety (Shanghai Market Supervision Food Administration [2024] No. 329)

Core message: In order to further strengthen the supervision and management of bulk food safety, standardize the sales and operation of bulk food, eliminate food safety hazards, and ensure the safety of food consumption by the people, the following notice is hereby issued on relevant matters.


Market Supervision Bureaus of all districts and Lingang New Area Market Supervision Bureau:

 

  In order to further strengthen the supervision and management of bulk food safety , standardize the sales and operation of bulk food , eliminate food safety hazards, and ensure the safety of food consumption by the people , the following matters are hereby notified:

 

  1. Supervise the fulfillment of principal responsibilities

 

  1. Improve food safety management system

 

  Urge food sales operators to obtain bulk food sales and operation projects in accordance with the law, establish and improve food safety management systems, strictly follow the " Food Safety Law of the People's Republic of China ", "Shanghai Food Safety Regulations", "Enterprise Implementation of Food Safety Subject Responsibility Supervision and Management Regulations", "Food Operation Process Hygiene Standard GB31621-2014" and other laws, regulations, standards, etc., implement food safety self-inspection requirements, and improve food safety levels. Urge food sales companies to strengthen the risk control of key foods such as bulk foods in conjunction with the formulation of a food safety risk control list, and implement a "daily control, weekly investigation, and monthly scheduling" work mechanism.

 

  2. Strengthening the management of practitioners

 

  Urge food sales operators to strengthen the legal and professional knowledge training of bulk food practitioners, guide them to strengthen food safety self-discipline, and further improve their awareness of responsibility and management capabilities. Practitioners who are in contact with directly ingested bulk food should hold a valid health certificate before they can work.

 

  (III) Regulating the sales and operation of bulk food

 

  Urge food sales operators to strictly implement the obligation to inspect bulk food purchases to ensure the legality of the food source and the safety of quality. When selling bulk food, food sales operators shall indicate the name of the food, production date or production batch number, shelf life, and the name, address, and contact information of the producer and operator on the container and outer packaging of the bulk food. The marked production date shall be consistent with the production date marked on the factory. The original production date and shelf life of packaged or subpackaged foods during the operation process shall not be changed. When selling and storing bulk foods that are directly ingested, facilities and equipment such as anti-corrosion, dust prevention, fly prevention, rat prevention, insect prevention, and pollution prevention shall be set up. Effectively covered or isolated containers shall be used to hold food, and sales tools shall be provided to ensure that they are not directly touched by consumers.

 

  II. Implementing the responsibilities of full-chain supervision

 

  1. Regulating business access

 

  Bulk food sales sites should have relatively independent areas or significant isolation measures. Bulk food that is directly imported should be separated from fresh livestock and poultry and aquatic products, and physically isolated at a certain distance. For the sale of bulk cooked food, there should also be special sales rooms, areas or counters. Internet food operators without physical stores are not allowed to issue bulk cooked food sales. In conjunction with the release and implementation of the "Shanghai Food Business License and Registration Management Measures", bulk food sales operators, except for the sale of bulk cooked food, do not need to conduct on-site inspections, but post-license supervision and inspections will be carried out within thirty working days from the date when the food sales operator obtains the food business license. If any non-compliance with the application materials or food safety requirements is found, it will be handled in accordance with the law.

 

  2. Strengthening supervision

 

  In conjunction with the city's special action to investigate and rectify food safety risks, bulk food safety is taken as a key investigation and rectification project. Inspections are carried out in accordance with the law on the purchase, storage, and sales of bulk food circulation links to further strengthen bulk food safety risk control, comprehensively investigate and rectify prominent common problems in bulk food safety, investigate and punish illegal and irregular behaviors in accordance with the law, and continuously standardize the bulk food business order. For the sale of bulk food directly imported, the "three-piece set" for food practitioners is implemented, namely wearing masks, hats, and gloves, to further standardize the operating behavior of practitioners.

 

  3. Strengthening random inspection and monitoring

 

  Focus on key places and key varieties, increase targeted sampling and monitoring of bulk foods, promptly discover food safety risks and hidden dangers in bulk food operations, urge food sales operators to make rectifications based on problems found in sampling inspections, and do a solid job of inspecting and disposing of unqualified foods.

 

  III. Improving Supervision Effectiveness

 

  1. Establishing a social co-governance structure

 

  Strengthen publicity and guidance, and widely publicize the knowledge of bulk food safety laws and regulations through flexible and diverse methods. In combination with daily supervision and special training, issue the "Food Safety Management Requirements for Bulk Food Sales" (Appendix 1) to bulk food sales operators, and urge bulk food sales operators to post it in a prominent location in the bulk food sales area to make it clear to consumers. Strengthen bulk food safety consumption reminders, improve consumers' self-protection ability to distinguish inferior and fake products, and guide consumers to consume rationally. Encourage consumers to report complaints to market supervision departments in a timely manner when they find problematic food or violations, and enhance consumers' awareness of rights protection.

 

  2. Forming a model and leading role

 

  We will continue to promote the "100,000,000" food safety project and the construction of "trustworthy supermarkets", carry out key scoring and assessment around prominent issues such as incomplete bulk food labels and naked storage, and enhance the effectiveness of demonstration construction. We will select a group of bulk food sales operators with standardized management and full implementation of main responsibilities, play a demonstration and leading role, and promote the overall improvement of bulk food safety management level.

 

  (III) Implementing categorized supervision

 

  In combination with the risk level assessment of food sales operators, the sales of bulk food will be taken as an important part of the assessment. According to the main business formats and different management conditions of bulk food sales operators, the risk classification management of food sales will be promoted. Food sales operators with high risk levels will be the focus of inspections, and the frequency of supervision will be increased to effectively improve the effectiveness of law enforcement and supervision.

 

  Bulk food safety supervision is an important part of the performance of food safety supervision duties. The market supervision bureaus of each district and the Lingang New Area should earnestly improve their ideological understanding, fulfill their duties, further consolidate the main responsibilities of food sales operators, and urge bulk food sales operators to complete self-inspection and self-correction in accordance with the "Bulk Food Sales Food Safety Management Requirements" before July 31, 2024. If they still fail to implement the relevant requirements, they will be severely investigated and punished in accordance with the law. The periodic work summary and the statistical table of bulk food safety supervision work (Appendix 2) shall be submitted to the Food Operation Division of the Municipal Bureau before September 30, 2024.
